<h2 id="373eea11-90fb-46d5-a64e-166bdc9e122c" data-toc-id="373eea11-90fb-46d5-a64e-166bdc9e122c" style="font-size: 24px; line-height: 1.2;">Intro</h2><p>As healthcare teams adopt more AI tools, incident response needs to catch up with everyday use. An AI-related issue may look small at first, such as the wrong file being uploaded, PHI being pasted into the wrong system, or a vendor connection exposing data unexpectedly, but regulated entities still have to treat security incidents and potential breaches with discipline. The HIPAA Security Rule requires regulated entities to implement policies and procedures to address security incidents, and HHS defines a security incident broadly enough to include attempted or successful unauthorized access, use, disclosure, modification, destruction, or interference with system operations.</p><h2 id="03b060b0-c8ed-4679-a19f-22d995030f67" data-toc-id="03b060b0-c8ed-4679-a19f-22d995030f67" style="font-size: 24px; line-height: 1.2;">Treat the Event Like an Incident, Not a Workflow Mistake</h2><p>A practical first step is to stop calling the problem “just a prompt issue” or “just a user error.” If an AI tool received information it should not have received, exposed output to the wrong person, pulled from the wrong system, or behaved in a way that affected the confidentiality, integrity, or availability of ePHI, healthcare teams should treat that as an incident that needs a formal response path. That does not automatically mean every event is a reportable breach, but it does mean the organization should move into documented incident handling rather than informal cleanup.</p><p>NIST’s updated incident response guidance makes the same broader point in a technology-neutral way: incident response should be integrated into cybersecurity risk management, and organizations should use a lifecycle that supports preparation, detection, response, recovery, and continuous improvement. Applied to healthcare AI, that means AI incidents should plug into the same governance structure used for other security events instead of being handled as isolated product exceptions. This is an inference from NIST’s framework-based guidance, but it is a strong one.</p><h2 id="a1e2eaf4-637d-4b51-9e75-ad204f2fa63a" data-toc-id="a1e2eaf4-637d-4b51-9e75-ad204f2fa63a" style="font-size: 24px; line-height: 1.2;">Contain First, Then Preserve What Happened</h2><p>Once an incident is suspected, the immediate priority is containment. OCR’s quick-response guidance says entities should execute response and mitigation procedures and contingency plans, immediately fix technical or other problems to stop the incident, and take steps to mitigate any impermissible disclosure of PHI. OCR’s cybersecurity newsletter also says regulated entities should contain the incident, determine the nature and extent of the damage, remove malicious components where relevant, mitigate vulnerabilities, and preserve data relevant to the investigation, such as logs and other artifacts.</p><p>For AI-related events, that may mean disabling a connector, suspending a workflow, revoking credentials, pausing vendor access, preserving audit logs, capturing the prompts or files involved, and recording which systems and users were affected. The exact technical steps will vary by environment, but the principle is stable: do not rush straight into business-as-usual before the organization has stopped the exposure and preserved enough evidence to understand what occurred. That is consistent with both OCR’s response guidance and NIST’s emphasis on detection, analysis, containment, and recovery.</p><h2 id="95545e6f-2ea6-4c0a-a1b6-6bd3043a28be" data-toc-id="95545e6f-2ea6-4c0a-a1b6-6bd3043a28be" style="font-size: 24px; line-height: 1.2;">Separate Security Incident Review From Breach Determination</h2><p>Healthcare teams also need to separate two related but different questions. First: did a security incident occur? Second: did the event rise to the level of a breach of unsecured PHI that triggers notification obligations? HHS explains that the Breach Notification Rule applies following a breach of unsecured PHI, and that an impermissible use or disclosure is generally presumed to be a breach unless the covered entity or business associate can demonstrate a low probability that the PHI was compromised through a risk assessment. That assessment must consider at least the nature and extent of the PHI involved, the unauthorized person, whether the PHI was actually acquired or viewed, and the extent of mitigation.</p><p>That distinction matters in AI workflows. For example, an employee pasting PHI into an unapproved tool may be a security incident immediately. Whether it is also a reportable breach depends on the facts, the tool, the exposure, the recipient, the data retained, and the mitigation available. HHS makes clear in other cyber contexts that breach determinations are fact-specific, which is a useful way to think about AI incidents too.</p><h2 id="b0e98804-5a01-40d0-be07-cf339b61717a" data-toc-id="b0e98804-5a01-40d0-be07-cf339b61717a" style="font-size: 24px; line-height: 1.2;">Know the Reporting Clock and the Vendor Chain</h2><p>When a breach of unsecured PHI does occur, the reporting clock matters. HHS says covered entities must notify affected individuals without unreasonable delay and no later than 60 days following discovery of the breach, and breaches affecting 500 or more individuals also require notice to HHS and, in some cases, the media within that same outer limit. For breaches affecting fewer than 500 individuals, covered entities still notify affected individuals without unreasonable delay, and they report to HHS no later than 60 days after the end of the calendar year in which the breach was discovered. OCR also stresses that the reporting period begins when the incident is first known, not when the investigation is complete.</p><p>Vendor communication matters too. HHS says business associates must identify and respond to suspected or known security incidents, mitigate harmful effects to the extent practicable, document incidents and outcomes, and report security incidents as required by the BAA. If a breach of unsecured PHI occurs at or by a business associate, the business associate must notify the covered entity without unreasonable delay and no later than 60 days from discovery. For healthcare AI tools, that means teams should already know who owns vendor escalation, what the contract requires, and how incident reporting will work before a problem ever happens.</p><h2 id="e30668e1-4b50-40a3-a110-83d5dcc9b805" data-toc-id="e30668e1-4b50-40a3-a110-83d5dcc9b805" style="font-size: 24px; line-height: 1.2;">Documentation and Lessons Learned Are Part of the Response</h2><p>Incident response is not finished when the system is back online. OCR says regulated entities should document security incidents and their outcomes, including details such as discovery, systems and data affected, response and mitigation activities, recovery outcomes, root cause analysis, and forensic data collected. OCR also recommends regular testing of security incident procedures and updating them with lessons learned from exercises and actual incidents.</p><p>That is especially important for AI use because many failures are operational, not purely technical. The root cause may be weak approval processes, unclear staff guidance, excessive permissions, missing audit visibility, or a vendor integration that was never mapped to the right governance lane. Framed as an inference from OCR and NIST guidance, the best post-incident fix is usually not “tell staff to be more careful.” It is tightening controls around data access, approved use cases, vendor oversight, logging, training, and escalation paths so the same class of incident is less likely to recur.</p><h2 id="5660009d-cfe2-4924-9dcf-0cad6587736b" data-toc-id="5660009d-cfe2-4924-9dcf-0cad6587736b" style="font-size: 24px; line-height: 1.2;">Conclusion</h2><p>Healthcare organizations do not need a separate universe of rules to respond to AI incidents. They need to apply existing security incident, breach assessment, vendor reporting, and recovery disciplines to new workflows with the same seriousness they would apply to any other system handling sensitive information.
