Artificial intelligence may be changing healthcare workflows, but it has not replaced the basics of HIPAA.The HIPAA Privacy Rule still sets national standards for protecting protected health information, and the Security Rule still requires safeguards for electronic protected health information. In practical terms, that means healthcare organizations cannot treat AI adoption like a side experiment outside the normal privacy and security framework. AI is another workflow, another data path, and another place where existing obligations still apply.<h2 id="52a31fb5-21e4-4fb5-8eff-3dcb29462c6b" data-toc-id="52a31fb5-21e4-4fb5-8eff-3dcb29462c6b" style="font-size: 24px; line-height: 1.2;">Minimum Necessary Still Matters</h2>One of the clearest examples is the minimum necessary standard.HHS explains that protected health information should not be used or disclosed when it is not necessary to satisfy a particular purpose or carry out a function. That matters in AI workflows because teams often move too quickly from “this tool could help” to “let’s paste in the full record.”In many routine situations, that is the wrong instinct. If a task can be done with less information, de-identified information, or no patient identifiers at all, that is the safer and more compliant starting point.<h2 id="41667f92-c52c-4de0-8a24-1a7e2b84974d" data-toc-id="41667f92-c52c-4de0-8a24-1a7e2b84974d" style="font-size: 24px; line-height: 1.2;">Security Requirements Still Apply</h2>HIPAA also still requires organizations to think beyond privacy and focus on security.The Security Rule requires covered entities and business associates to protect the confidentiality, integrity, and availability of electronic protected health information through administrative, physical, and technical safeguards. HHS guidance on risk analysis adds that regulated entities must perform an accurate and thorough assessment of potential risks and vulnerabilities to ePHI.For AI adoption, that means organizations should be asking concrete questions. What data is entering the system? Where is it stored? Who can access it? What logs exist? What new vulnerabilities does this workflow introduce?<h2 id="05d47d39-1655-4092-b068-fdd99fe5a8c9" data-toc-id="05d47d39-1655-4092-b068-fdd99fe5a8c9" style="font-size: 24px; line-height: 1.2;">Vendor Review and BAAs Still Matter</h2>Vendor relationships are another area where HIPAA still matters just as much as before.HHS states that when a cloud service provider creates, receives, maintains, or transmits ePHI on behalf of a covered entity or business associate, a HIPAA-compliant business associate agreement is required. HHS also explains that a covered entity’s contract with its business associate must include specified elements and cannot authorize uses or disclosures that would violate the Privacy Rule.In other words, healthcare organizations cannot evaluate AI vendors only on speed, interface quality, or feature set. They also need to understand whether the vendor is functioning as a business associate, whether a BAA is required, and whether the technical and contractual environment actually supports compliant use.<h2 id="5c86bb1f-43e9-4545-b4ac-12bbde7c56e2" data-toc-id="5c86bb1f-43e9-4545-b4ac-12bbde7c56e2" style="font-size: 24px; line-height: 1.2;">A Contract Alone Is Not Enough</h2>Another point teams often miss is that HIPAA compliance is not satisfied by contracts alone.HHS’s cloud-computing guidance notes that even when a BAA is in place, the covered entity or business associate still needs to understand the environment well enough to conduct its own risk analysis and risk management. That is an important reminder for AI adoption.A signed agreement may be necessary in some cases, but it does not replace sound governance, approved-use policies, access controls, or workforce training. Organizations still have to make sure the way people actually use the tool matches the way leadership thinks the tool is being used.<h2 id="ae9eb9d8-969d-45cf-9ad4-1c6aeb4967f9" data-toc-id="ae9eb9d8-969d-45cf-9ad4-1c6aeb4967f9" style="font-size: 24px; line-height: 1.2;">What This Means in Practice</h2>This is why healthcare AI readiness is as much an operational issue as a legal one.HIPAA compliance in the age of AI means giving teams clear rules about what tools are approved, what data can and cannot be entered, when human review is required, and when issues must be escalated. The law did not create a separate AI exception that relaxes old expectations.If anything, AI makes long-standing HIPAA principles more important because speed, convenience, and automation can make weak habits scale faster. The organizations that handle this best will not be the ones with the most aggressive rollout.
