<p>Rolling out an AI tool in healthcare is not just a product decision. It is also a cybersecurity decision.</p><p>HHS says the HIPAA Security Rule establishes national standards to protect electronic protected health information and requires regulated entities to implement administrative, physical, and technical safeguards. Those safeguards are meant to protect the confidentiality, integrity, and availability of ePHI and to guard against reasonably anticipated threats and impermissible disclosures.</p><h2 id="76b93e43-d3e9-4074-b04c-506e96ff7e69" data-toc-id="76b93e43-d3e9-4074-b04c-506e96ff7e69" style="font-size: 24px; line-height: 1.2;">Start With the Most Basic Question</h2><p>One of the first questions should be simple: will this tool touch ePHI at all?</p><p>If the answer is yes, the security review should begin before rollout, not after. HHS’s Security Rule summary makes clear that covered entities and business associates must consider their size, capabilities, infrastructure, costs, and the probability and criticality of potential risks when selecting security measures.</p><p>In practice, that means AI tools should be evaluated in the context of the actual workflow, not just by reading vendor marketing materials.</p><h2 id="803514e7-3c29-49b0-9188-2fb0d66aea9b" data-toc-id="803514e7-3c29-49b0-9188-2fb0d66aea9b" style="font-size: 24px; line-height: 1.2;">Understand the New Attack Paths</h2><p>The next question is: what new attack paths does this tool create?</p><p>HHS’s healthcare-specific Cybersecurity Performance Goals are designed to help healthcare organizations prioritize high-impact practices, improve response when events occur, and minimize residual risk. The essential goals include mitigating known vulnerabilities, email security, multifactor authentication, basic cybersecurity training, strong encryption, and basic incident planning and preparedness.</p><p>Those priorities matter even more with AI adoption because new tools often introduce new integrations, credentials, permissions, and user behaviors.</p><h2 id="49ccfd3a-6fae-40f3-a54b-c8e94f4e9ef5" data-toc-id="49ccfd3a-6fae-40f3-a54b-c8e94f4e9ef5" style="font-size: 24px; line-height: 1.2;">Access Control Still Matters</h2><p>Another important question is: who can access the system, and how tightly is access controlled?</p><p>HHS explains that technical safeguards should help protect ePHI from improper alteration or destruction and limit access to those granted access rights. In its October 2024 cybersecurity newsletter, OCR also highlighted granular role-based access, network segmentation, and strict limits on privileged accounts and administrative tools as practical ways to reduce exposure.</p><p>That matters because an AI system can become risky even if the model itself works well, simply because access is too broad or permissions are poorly managed.</p><h2 id="257df464-11f2-4398-b673-2c4f272d5260" data-toc-id="257df464-11f2-4398-b673-2c4f272d5260" style="font-size: 24px; line-height: 1.2;">Do Not Overlook Human-Factor Risks</h2><p>Healthcare teams should also ask: how will we defend against human-factor attacks around this tool?</p><p>OCR’s October 2024 newsletter warns that social engineering remains prevalent because it works and identifies phishing as one of the most common attack types. The same newsletter notes that informing workforce members about emerging threats can be part of a regulated entity’s Security Rule obligation to maintain a security awareness and training program.</p><p>In other words, rollout is not finished when access is turned on. People need to know how to use the system safely and how attackers may try to exploit confusion, urgency, or excitement around a new tool.</p><h2 id="dd16644b-4a09-400f-8aca-c0b4b54ac133" data-toc-id="dd16644b-4a09-400f-8aca-c0b4b54ac133" style="font-size: 24px; line-height: 1.2;">Plan for Monitoring and Response</h2><p>A fifth question is: do we have a clear process for monitoring, detection, and response?</p><p>HHS’s cybersecurity guidance for the healthcare industry points to real-world attack trends from OCR breach reports and investigations and emphasizes that Security Rule compliance can help detect and mitigate common cyberattacks. The HHS Cybersecurity Performance Goals also include incident planning and preparedness as one of the essential goals.</p><p>That means teams should not just ask whether an AI tool is useful. They should ask what logs exist, who reviews them, what unusual behavior would trigger escalation, and what the response path looks like if something goes wrong.</p><h2 id="cedffd04-54d3-464a-bd37-9a48d6b39be4" data-toc-id="cedffd04-54d3-464a-bd37-9a48d6b39be4" style="font-size: 24px; line-height: 1.2;">Make AI Part of the Broader Security Program</h2><p>It is also worth asking whether AI risk is being treated as part of the broader security program or as a side project.</p><p>NIST’s Cybersecurity Framework 2.0 is designed to help organizations understand, assess, prioritize, and communicate cybersecurity risk, and its six functions now include the added Govern function alongside Identify, Protect, Detect, Respond, and Recover. NIST also explains that its AI Risk Management Framework and Generative AI Profile are intended to help organizations identify unique risks posed by generative AI and align risk management actions with organizational goals and priorities.</p><p>For healthcare organizations, that is a strong reminder that AI should be folded into normal governance and risk management, not treated as an isolated experiment.</p><h2 id="ebefabd5-d073-4101-96b9-6ecebfc0d451" data-toc-id="ebefabd5-d073-4101-96b9-6ecebfc0d451" style="font-size: 24px; line-height: 1.2;">Better Security Questions Lead to Better Rollouts</h2><p>The best AI rollouts in healthcare will not be the ones that move fastest. They will be the ones that ask better security questions early.</p><p>What data is involved? What access is needed? What new vulnerabilities does this create? How are users trained? How will incidents be detected and managed?</p><p>In healthcare, AI security is not a separate conversation from patient safety and privacy. It is part of the same operational discipline.
